For the writers out on the web wanting to learn how to earn money online one of the best options is starting a blogging business. This means starting a blog on a subject you have some expertise in, marketing the blog, and monetizing the blog. If you are not sure whether or not you would like to start a blog or a static website for your online business the main difference is a blog requires constant updates. Static websites on the other hand do not require constant updates, but do not have the same interactivity with your audience. There are many free blogging platforms out on the web that will allow you to create a blogging business for free. Blogger and WordPress which you can find by doing a Google search are two of the most common. They will give you a URL, domain name, and hosting all free. If you would prefer to have a blog which is not under the restrictions of free hosting it is possible to purchase a domain name, hosting, and upload the wordpress cms. For those starting out I highly recommend using the free hosting until you know whether or not blogging is right for you.

When you begin creating a blogging business the first step is choosing a topic. This in many cases is what makes or breaks an online business. There are a few factors you should take into consideration when choosing a blogs topic. The first is how much potential website traffic is in the niche. To find this go to Google adwords keyword tool which you can find by searching Google. Type in a term that you think fits the niche you are wanting to start a blog about. For all terms it should equal to at least 100k monthly searches. This may sound like quite a bit, but for webmasters we know that top postion only gets around half the search volume dropping this number to 50k. This depending on conversion and monetization techniques will equal one to three thousand in income. Another important factor when choosing a blog topic is your interest in the subject. Far too many people pick a traffic because of traffic alone. You need to be truly interested in the topic of blog you start. Usually you will not see the full income generation of your blog for a couple years so pick something you can write about for years.

Running a blog and earning from the traffic will require daily content creation and monetization techniques. Writing everyday is an extremely important part of blogging and will be what keeps your audience coming back. If it is impossible to write everday then you should attempt to write many articles one day and publish them throughout the week. Monetization is somewhat difficult to get the hang of. I highly recommend not picking one monetization technique and thinking that you are done because you make a little bit of money. For a blog it is a good idea to start out with ppc publishing until the blog really gets going. Once the blog starts generating traffic you should begin considering affiliate marketing with amazon, clickbank, or walmart. Another form of monetization for writers is writing an entire ebook on your niche and selling it on your blog. You can accept payments with a paypal.com account.

How the major stock indexes fared Tuesday (AP)

The mere discussion of more economic stimulus from the Federal Reserve was enough to send stocks higher Tuesday. The Dow Jones industrial average had its third day of gains.

Minutes from the Fed's latest policy meeting on Aug. 9 showed that central bank officials discussed a variety of options to bolster the economy, including buying more Treasury bonds. In the end, they decided to keep interest rates low until at least mid-2013. The news that more aggressive action was being considered gave investors a reason to buy stocks.

The Dow rose 20.70 points, or 0.2 percent, to 11,559.95.

The Standard & Poor's 500 rose 2.84 points, or 0.2 percent, to 1,212.92.

The Nasdaq composite index rose 14, or 0.6 percent, to 2,576.11.

For the week:

The Dow is up 275.41 points, or 2.4 percent.

The S&P 500 is up 36.12, or 3.1 percent.

The Nasdaq is up 96.26, or 3.9 percent.

For the year to date:

The Dow is down 17.56, or 0.2 percent.

The S&P 500 is down 44.72, or 3.6 percent.

The Nasdaq is down 76.76, or 2.9 percent.

Snow Leopard to get iCloud support in 10.6.9 update?

Apparently those of you who aren't upgrading to Cupertino's latest and greatest desktop OS will be able to sling bits through iCloud with the upcoming 10.6.9 update. The screenshot above comes via an eagle-eyed developer, who's already upgraded his MobileMe account to the service and also happened to open its forebearer's preference pane on a machine running Tiger. No word on when it'll drop (we'd place our bets alongside iOS 5's launch this fall), but looks like those of you running Snow Leopard got some readin' to do.

HealthTech FAIL: Lessons For Entrepreneurs From Health Startups Gone Awry

Train WreckHealthtech is an ever-growing sector, but from the $1 billion pool VCs poured into startups over the last year, health companies only received about 3 percent of that total. Not many healthtech startups have been able to secure those big venture rounds; however, last week, I highlighted one healthtech company that seems to be doing it right: Zocdoc, which raised a $50 million round from DST earlier this month, and offered a few takeaways for startups looking to learn from Zocdoc's experience. Study to look at hereditary prostate cancer in Blacks | louisianaweekly

OMAHA ? Creighton Uni?versity?s Hereditary Cancer Cen?ter, has received a three-year, $731,278 grant from the U.S. Department of Defense to study the role heredity plays in prostate cancer among Blacks.

?Prostate cancer is the leading cause of cancer death among men in the United States,. Afri?can American men have two times the occurrence of prostate cancer as do Caucasian men and suffer a significantly higher mortality as well,? said Henry Lynch, M.D., principal investigator and Creighton Here?ditary Cancer Center director.

?While it?s estimated that about 10 percent of all prostate cancers have a hereditary link, the problem has been understudied in African Americans. With few exceptions, relatively little is known about the role genetics play in this population,? noted Lynch, holder of the Charles F. and Mary C. Heider En?dowed Chair in Cancer Re?search.

The study will focus on identifying the hereditary factors of the disease that are specific to Blacks.

?The goal is to develop early and intensive screening and prevention management strategies that will decrease African Ameri?cans? incidence of as well as death rate from hereditary pro?state cancer,? he said.

Jackson State University in Mississippi is collaborating in the study. The goal is to involve 300 Black prostate cancer patients from the Omaha area and about 500 from Jackson, Miss., in the effort.

The research team includes members of Creighton?s Here?ditary Cancer Center; Ol?g?b??miga Ek?n?day?, M.D., associate professor of epidemiology at Jackson State University, and his staff; Sade Kosoko-Lasaki, M. D., associate vice president of Health Sciences Multicultural and Community Af?fairs at Creigh?ton and co-director of the University?s Center for Pro?moting Health and Health Equality; and Paulos Yohannes, M. D., Creighton assistant clinical professor of surgery.

Android Game Review: Sheep Impact

This one's a simple one, but still worth your time. It's called Sheep Impact, and the whole premise of the game is that you fly around in a hot air balloon, rescuing sheep that are inexplicably strapped to dynamite.

Sheep Impact is one of those "ascend when you touch the screen" games, so essentially, you're trying to time to descent correctly so you can pick up the sheep (done by running into them) and then ascending before you crash into anything. It's exactly what you'd expect if you played any games in this genre, so you know what you're getting.

Graphically, Sheep Impact is simple but cutesy, if I'm allowed to say that. Colors are bright and sheep look, well, like sheep. Because of the simple graphics, the game hums along nicely on my EVO 3D, but I'd imagine you'd still get great performance on lower spec'd phones.

Scoring is done via a medal system, so nabbing all the sheep nets you a gold medal. Miss one (or some), you get a silver, so on and so forth. Grabbing the coveted gold becomes more difficult as you venture into the later levels, because more and more sheep keep getting tacked on to your list to rescue.

Did Anthony's parents reveal anything?

The first promo showing actual footage from Dr. Phil?s much-hyped ?exclusive, in depth? interview with Casey Anthony's parents is out, and the brief clip hints that George and Cindy Anthony drop a bombshell on the show.

The promo in question is no longer available on YouTube, but this earlier tease for the episode is still up.

While the preview doesn?t feature a single quote from the couple in their first interview since daughter Casey was acquitted of charges relating to the death of their granddaughter Caylee, it does highlight Dr. Phil?s questions and reactions. In between the requisite ?Do you buy that that was an accidental drowning?? and ?You know the truth, don?t you?? lines, there was one telling take.

?America?s never heard this explanation before,? the daytime host said in a confrontational moment, following an as-yet-unknown statement from the Anthonys. ?Why have you sat on this information??

Those who?d like the answer to that question and others will have to wait a little while longer. Dr. Phil?s interview with George and Cindy Anthony airs Sept. 12.

'The Help' reigns again over storm-soaked weekend

(AP) ? "The Help" remained Hollywood's top draw with $14.3 million on a slow late-summer weekend whose business was even more sluggish as many East Coast theaters closed to ride out the storm there.

Irene was downgraded from a hurricane to a tropical storm Sunday, but the weekend already was a lost cause for many theaters in its path. Studio executives estimate that about 1,000 theaters shut down for at least part of the weekend and that business may have been off 15 to 20 percent because of the storm.

"It was a wild weekend," said Dave Hollis, head of distribution at Disney, which released DreamWorks Pictures' "The Help." ''All things considered, to kind of come out with business down only 15 to 20 percent is something to be pretty thankful for."

"The Help" has been the No. 1 film for two-straight weekends. The acclaimed adaptation of Kathryn Stockett's novel about black Southern maids sharing stories about white employers amid the civil-rights movement raised its domestic total to $96.6 million and should cross the $100 million mark Tuesday.

Late August often is a dumping ground for movies with slim commercial prospects, and Irene cut even further into receipts for the weekend's three new wide releases.

Zoe Saldana's action tale "Colombiana," released by Sony, opened in second-place with $10.3 million. Guy Pearce and Katie Holmes' horror story "Don't Be Afraid of the Dark," a FilmDistrict release, debuted in third with $8.7 million. Paul Rudd's comedy "Our Idiot Brother," distributed by the Weinstein Co., premiered at No. 5 with $6.6 million.

"Colombiana" features "Avatar" star Saldana as an assassin out for revenge against the drug lords responsible for her parents' deaths. "Don't Be Afraid of the Dark," produced by Guillermo del Toro ("Pan's Labyrinth," is a remake of the 1970s TV movie about a household terrorized by tiny, savage creatures. "Our Idiot Brother" stars Rudd as a happy-go-lucky guy doing time with his three sisters after serving a short prison sentence.

Business was strong Friday night for "Don't Be Afraid of the Dark" in the New York City area, but as the storm crept closer Saturday, theaters either closed or became ghost towns, said Bob Berney, FilmDistrict's head of distribution.

Berney said he stopped by a theater complex in suburban Westchester County Saturday night and only about 25 people had turned out for 7:30 p.m. shows.

"It was just dead," Berney said. "They were open but no one was there, whereas in Manhattan, I think all the theaters were closed."

Studios base their weekend reports on actual revenues for Friday and Saturday and estimates for business on Sunday.

But this weekend's numbers were more of a shot in the dark. Some theaters did not report their weekend grosses, and it was uncertain how many cinemas might remain closed Sunday or how big an audience might turn up in the wake of the storm.

"I think everybody is trying to lean toward conservative estimates," said Rory Bruer, head of distribution at Sony, who said "Colombiana" managed to beat the studio's projections of an $8 million opening weekend despite the weather.

Overall business plunged, with domestic revenues totaling $88 million, down 23 percent from the same weekend last year, when "Takers" led with $20.5 million, according to box-office tracker Hollywood.com.

"It's not like this was destined to be a blockbuster weekend, anyway," said Hollywood.com analyst Paul Dergarabedian. "But going to the movies is not a top priority when you're concerned about severe weather."

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers also are included. Final domestic figures will be released Monday.

TRIPOLI (AP) ? British warplanes struck a large bunker Friday in Moammar Gadhafi's hometown of Sirte, his largest remaining stronghold, as NATO turned its attention to loyalist forces trying to hold back advancing Libyan rebels in the area.

The airstrikes came a day after fierce clashes erupted in the Libyan capital, which remained tense as rebels hunted for the elusive leader and his allies, detaining suspected loyalists and raising concerns about human rights violations.

Rebels were searching Friday for the remnants of pro-Gadhafi forces in Tripoli's Abu Salim neighborhood, which saw very heavy fighting the day before. The rebels had detained seven men and one woman and loaded them into a pickup truck in a rural area between Abu Salim and the airport, saying Gadhafi forces might be trying to blend in with civilians.

"Things are still not stable and we are arresting anybody we find suspicious and taking them to the military council," said field commander Fathi Shneibi.

Meanwhile, at a clinic attached to an Abu Salim fire station, injured men believed to be Gadhafi supporters or fighters were left moaning and calling for water. Curious neighborhood men climbed the stairs to look at them, but none offered help.

One of the wounded said he was from Niger and denied any links to Gadhafi. Asked why he was in Libya, he said, "I really don't know." He did not give his name.

Signs also emerged that the situation can turn far worse.

Dozens of decomposing bodies were piled up in an abandoned Abu Salim hospital, a grim testament to the chaos roiling the capital. It was not clear when the men had been killed. The floors were covered with shattered glass and bloodstains, and medical equipment was strewn about.

One room had 21 bodies lying on gurneys, with 20 more in a courtyard next to the parking lot ? all of them darker skinned than most Libyans. Gadhafi had recruited fighters from sub-Saharan Africa, but many others from the region are in Libya as migrant workers.

It was not clear who had killed the men, but since the uprising began the rebels often suspect sub-Saharan Africans of being mercenaries.

A spokesman for the International Committee of the Red Cross, Steven Anderson, said the neutral aid group was concerned about the treatment of detainees on both sides in Tripoli. He declined to discuss specific examples, though, saying any findings are discussed confidentially with those involved.

The Geneva-based ICRC has been able to visit some prisoners on both sides, said Anderson, but "there are hundreds more probably."

Tripoli, meanwhile, enjoyed the quietest day yet since the rebel takeover, though pro-Gadhafi forces were shelling the airport and sporadic shooting was reported elsewhere in the metropolis of 2 million people.

At the first Friday prayers since Tripoli fell to the rebels, hundreds of people crowded a mosque in central Tripoli, listening as the imam praised the rebels for taking up arms against Gadhafi. He said they had "liberated the land inch by inch, house by house, alley by alley," using a famous phrase from a Gadhafi speech against the uprising.

Hearing the phrase, worshippers laughed or shouted "Allahu Akbar!"

Afterward, the worshippers marched out chanting in support of revolution. "Hold your head high, you are a free Libyan," some shouted.

There had been a plan to hold prayers at the Martyr Square, which was called Green Square under Gadhafi's regime, but it was littered with bullet casings and trash so worshippers decided to hold the service at a nearby mosque.

Mahmoud Shammam, a spokesman for the rebel council, told reporters in Tripoli that the rebel government had begun shifting from Benghazi to Tripoli, taking over official buildings and setting up a security committee.

He also said some people from Gadhafi's regime would be included in the new government.

"The only people we are going to exclude are the people who killed others and stole money," Shammam said in Tripoli.

The military alliance said NATO warplanes targeted 29 vehicles mounted with weapons near Sirte, a city of 150,000 about 250 miles (400 kilometers) east of the Libyan capital of Tripoli. Rebels are trying to advance toward Sirte but expect fierce resistance from tribesman and townspeople loyal to Gadhafi.

The rebel leadership, trying to avoid the bloodshed that occurred in the battle for Tripoli, has also been trying to secure Sirte's surrender, but the two main tribes have rejected negotiation efforts.

Gadhafi denied his people basic rights, cracked down harshly on any hint of dissent and squandered the country's vast oil and gas wealth.

But tribal loyalties are strong in the desert nation of 6 million. Gadhafi also seeded supporters in key posts and built up militias and armed "revolutionary committees" to be the final line of support for him and his powerful sons if regular military forces defected.

Gadhafi has tried to rally his followers from hiding, calling on them in an audio appeal as recently as Thursday to fight and kill the rebels.

The two main tribes in Sirte, the Gadhadhfa and the Urfali, remain loyal to the Libyan leader, although many others have disavowed him since the uprising began in mid-February, inspired by a wave of Arab revolutions.

Mohammed al-Rajali, a spokesman for rebel fighters in the east, said the rebels were trying to reach out to smaller tribes in Sirte but no progress had been made.

But the latest NATO airstrikes on loyalist vehicles defending Sirte appeared aimed at paving the way for the rebel advance if a negotiated settlement proves impossible.

In London, British Defense Secretary Liam Fox said some elements of the Gadhafi regime were in Sirte "where they are still continuing to wage war on the people of Libya." He said NATO would continue to strike at pro-Gadhafi forces.

"The regime needs to recognize that the game is up," Fox said.

Maj. Gen. Nick Pope, a British military spokesman, said royal Air Force jets also hit a large headquarters bunker in Sirte with a salvo of air-to-surface missiles.

NATO also bombed surface-to-air missile facilities near the Tunisian border, a statement said.

The Tripoli airport was under rebel control but faced regular shelling from pro-Gadhafi forces to the east. At least three planes were burned in heavy shelling overnight, although the airport otherwise appeared largely intact, with a dozen other passenger planes on the tarmac.

"NATO is bombing those guys but they are still shelling from the east of the airport," Nasser Amer, a civil aviation official told The Associated Press. Amer, a former pilot, traveled to Tripoli to try to get the airport running again.

?It?s been really, really fun, but it?s also been a while and I?ve been getting bored,? Allegra wrote on his Twitter feed. ?So, the week after next I will be starting an internship with Apple.?

JailBreakMe 2 and 3 used Web-based exploits to unlock iOS devices with a single click to a specifically crafted PDF file that exploited a weakness in the iOS PDF interpreter. The result was a Web site that could break iOS devices free of Apple?s tether with a single click. Apple moved quickly to close the gaps, but last month the potential malicious use of same exploit caused Germany to issue a consumer alert for iOS devices.

Allegra didn?t say what he?ll be working on at Apple. The obvious guess would be mobile device security, but there are undoubtedly many projects at Apple that could hold his interest.

Allegra has admitted to being an Apple fan, and says he did not see his jailbreaks as an struggle against a Big Brother-like Apple.

Obama invokes Sept 11 attacks in call for service (Reuters)

WASHINGTON (Reuters) ? President Barack Obama urged Americans on Saturday to recall the spirit that united the country after the September 11 attacks and take part in a national day of service to mark the anniversary next month.

In remarks acknowledging the "great challenges" that confront the U.S. economy, and could hurt his reelection chances next year, Obama also sought to rise above the partisan political rancor that has divided Washington all summer.

"As we mark this solemn anniversary, let's summon that spirit once more. And let's show that the sense of common purpose that we need in America doesn't have to be a fleeting moment; it can be a lasting virtue," Obama said in his weekly radio address.

With unemployment stuck above 9 percent, Democrat Obama is fighting for more measures to boost growth and hiring but has been thwarted so far by Republicans in Congress, who control the House of Representatives.

He will unveil a package of employment-creating measures in a major jobs speech after the September 5 Labor Day holiday which White House aides say will contain a number of new proposals.

Obama and his wife Michelle will mark the 10th anniversary of the attacks by visiting Ground Zero in New York, the Pentagon, and the site in Shanksville, Pennsylvania, where the fourth hijacked airline crashed after its passengers .

"But even if you can't be in New York, Pennsylvania or Virginia, every American can be part of this anniversary. Once again, 9/11 will be a National Day of Service and Remembrance," Obama said.

The attacks, blamed on Osama bin Laden's al Qaeda extremist network, killed nearly 3,000 people in September 2001. Bin Laden was killed earlier this year in an attack on his compound in Pakistan and his network has been splintered and weakened by repeated attacks by allied western forces in recent years.

Judge: Jury can hear Conn. home invasion statement (AP)

NEW HAVEN, Conn. ? Jurors will be able to hear the chilling confession of a paroled burglar charged with killing a woman and her two daughters in a 2007 home invasion, because there was no evidence to support his claim that he was sleep-deprived when he gave it, a judge ruled Friday.

Defense attorneys for Joshua Komisarjevsky, whose trial begins next month, argued that he had been awake for more than 40 hours by the time he finished giving two statements to police about what happened during the home invasion in Cheshire. They said the statements should not be used as evidence during the trial and asked the judge to bar t.

New Haven Superior Court Judge Jon Blue rejected those claims and set another pretrial hearing for Sept. 12, exactly a week before the trial is set to begin.

"There is no indication that at any time the defendant said he was tired," Blue said. "It would be purely speculative for the court to find that the defendant was sleep-deprived at any point in this saga."

Blue noted that Komisarjevsky was read his Miranda rights at least four times after being arrested and was no stranger to the criminal justice system, having been charged before with burglaries and other crimes.

Authorities say Komisarjevsky and co-defendant Steven Hayes killed Jennifer Hawke-Petit and her 11- and 17-year-old daughters, Michaela and Hayley, on July 23, 2007, after breaking into their suburban home and severely beating Hawke-Petit's husband, Dr. William Petit Jr., who survived. Hawke-Petit was sexually assaulted and strangled, and the two girls died of smoke inhalation from a fire that was set before the two suspects fled the house, police said. Michaela was also sexually assaulted, investigators said.

Hayes was convicted of capital felony, murder and other crimes last year and is now on death row. Komisarjevsky also could get the death penalty if convicted.

William Petit didn't attend Friday's hearing, a rare absence from the proceedings. His father, William Petit Sr., said his son was taking a long-needed vacation.

"We're definitely pleased," the elder Petit said after the hearing ended. He said Komisarjevsky's confession to police "was given voluntarily, and it's going to be important to the trial."

In the statement, a copy of which The Associated Press obtained this week, Komisarjevsky called the crime "home invading gone terribly wrong" and insisted he never intended to kill the family. He claimed Hayes came up with the idea to kill the family because he was worried the pair would leave behind evidence. He said Hayes doused the house with gasoline and lit the match that engulfed the home in flames.

Komisarjevsky also said he tied up the victims and molested Michaela. But he said Hayes escalated the violence at key moments during the night of terror, foreshadowing what is likely to be the defense strategy at Komisarjevsky's trial.

During his trial, Hayes portrayed Komisarjevsky as the mastermind.

Komisarjevsky and Hayes were arrested shortly after the killings, when they crashed the family's car into police cruisers.

Prosecutors say the two men, paroled burglars who met at a halfway house, were equally responsible for the crime, which drew comparisons to the 1959 slayings portrayed in Truman Capote's book "In Cold Blood."

Komisarjevsky's lawyer, Walter Bansley III, asked the judge to consider his client's state of mind when he gave the police statements.

"The detective well knew that Mr. Komisarjevsky had been up all the night before," Bansley said.

Komisarjevsky's lawyers said their client had not slept for 29 to 31 hours before police first questioned him. When he made a second statement to police, it had been 41 to 43 hours since he had last slept, they said.

State's Attorney Michael Dearington said Komisarjevsky "never complained ... that he was suffering from sleep deprivation."

The judge and Dearington also rejected defense suggestions that Komisarjevsky was also impaired by injuries from the car crash when he confessed.

The Problems with Patent Reform

Patent reform is about to negotiate the final hurdle standing between it and President Obama?s desk, where it would almost certainly be signed into law. The hurdle is a Senate cloture vote scheduled for September 6. The patent reform bill ? which these days goes by the friendly name of the ?Leahy-Smith America Invents Act? ? has already passed the House; clearing the Senate cloture vote pretty much guarantees passage and enactment.

Listening to the White House and lawmakers from both sides of the aisle, passage is both inevitable and will work economic wonders for all Americans: the bill will ?boost patent quality, reduce the backlog of patent applications, and cut costs for American companies? by ?provid[ing] greater certainty and consistency for innovators? rights,? reducing legal costs on small businesses, and helping innovators commercialize their inventions, ultimately ?cut[ting] the red tape that . . . holds our whole economy back?. Indeed, as soon as Congress sends the bill to the President, it will be ?easier for entrepreneurs to patent a new product or idea ?- because we can?t give innovators in other countries a big leg up when it comes to opening new businesses and creating new jobs.?

You may recall that similar legislation has been proposed for at least the last six years; however, 2011 is the first year that patent reform will allegedly ?boost the economy? or ?create jobs.? What in the 2011 legislation is newly geared at invention commercialization and economic growth through patent reform?

Nothing, as it turns out. Instead, as several non-politician commentators have pointed out, many provisions newly stuffed into the current bill are certain to have a negative impact on patent examination backlog while failing to address other real problems with the patent system, suggesting that those praising the bill are either not paying attention to its contents or are simply desperate to pass anything branded under ?job growth? or ?reform? in a legislative system that is largely perceived as dysfunctional.

This opinion piece takes a closer look at three problems ? stripping of USPTO funding, unique anti-patent treatment for the financial sector, and prior user rights that undermine technological disclosure and promote trade secret culture ? with the Leahy-Smith America Invents Act now before the Senate and opposes its enactment. An examination of the substance of the bills and the legislative process that created it shows no red tape will be cut by, and few inventions sped to market by, the reforms born more out of partisan point scoring and special interest catering than any interest in reducing patent backlog and increasing patent quality and job creation.

First up is the most tragic provision of the America Invents Act ? Section 22, which limits how much the USPTO can use its own fees. That is, Section 22 permits Congress to take the money the USPTO earns from providing services to applicants and divert the funds to non-USPTO projects. The practice, termed ?fee-diversion,? has been ongoing and resulted in cuts to USPTO services, as the USPTO Director himself has stated, including limiting new Examiner hiring and acquisition of new IT infrastructure that would help combat the growing patent backlog.

The Senate originally passed their version of a patent reform bill (S.23) in March 2011 by a 95-5 bipartisan vote. S.23 guaranteed the USPTO could keep and plan around all the user fees it collects, thanks in large part to the efforts of Senator Tom Coburn (R-OK). The House, however, in an effort spearheaded by Reps. Paul Ryan (R-WI) and Hal Rogers (R-KY), reversed this benefit. The House version currently awaiting Senate approval includes a new Section 22, which permits Congress to take excess USPTO funding from a special fund and spend it elsewhere. While Representative Rogers stated that excess USPTO funds will be spent only on the USPTO, the actual language of Section 22, in addition to the pressure from the new debt-ceiling committee to squeeze all excess revenues into the general treasury, does not give the USPTO any certainty as to what funding will be available in coming fiscal years. Additionally, the fee diversion of Section 22 undermines any fee-setting authority given to the USPTO; the USPTO cannot set fees to recover USPTO expenses if those fees are appropriated by Congressional third-parties to cover other government expenses. (It?s worth noting that the House also added a sunset provision to the USPTO fee-setting authority, so it will go away in seven years anyway.)

So all the exhortations that the patent reform bill will speed inventions to market by reducing the patent backlog are almost certainly false, at least to the degree that such backlog might be addressed with additional USPTO funding. Without being able to hire additional Examiners or make long-term decisions based on long-term funding, the Office will have few tools to improve patent quality and reduce the nearly 700,000 application backlog (it currently takes the Office over 2 years to act on an application filed today). As a frequent user and customer, I find that USPTO operations are already in a precarious state. Continuing fee diversion, under Section 22 of the current House bill, will only worsen this situation by preventing the USPTO from making long-term plans or funding initiatives to meet the demands of American innovation like reducing the examination backlog.

Next up, provisions doling out benefits to the special interest of the day: banks. Sections 14 and 18 of the America Invents Act establish special anti-patent treatment of inventions on tax strategies and pure business/financial services methods. In a special-interest coup for the bank lobby, Senator Charles Schumer (D-NY) added provisions to the bill that invalidate entire swaths of tax strategy patents and provide a unique procedure to tie up patents asserted against their business models in new USPTO post-grant review. The only reason these narrow areas of innovation are undeserving of patent protection is because established financial service entities don?t want to pay licensing fees or damages due to patents their businesses infringe. The financial servicers would rather use the patented tax strategy, check-processing method, stock-transfer mechanism, or what-have-you without the person who came up with the strategy/method/mechanism getting any cut of the profits or potentially entering the market and upsetting established market shares with disruptive innovation. Of course, financial services innovation will quickly disappear altogether when the patent system cannot protect or reward it, which is likely exactly what the lobbying financial servicers want.

As former Federal Circuit Judge Paul Michel and IP commentator Hal Wegner have noted (and received criticism from the banking lobby for so noting), given the mechanisms and (lack of) reasoning for Congress?s special treatment of the financial service industry, it?s unclear why US lawmakers, or even foreign lawmaking bodies, will not identify and exclude other industries from patent protection on disruptive innovation, so long as those industries lobby Congress hard enough. Maybe China will decide that pharmaceutical methods are not a patent-worthy industry, and this just happens to result in all US-invented drug treatments having no patent rights in their country? Indeed, the fact that only financial services patents were given the axe in the America Invents Act, despite long-standing outcry against software patenting in this country, suggests that the anti-software patent voices just need to start playing donation hardball with influential senators to get software patents similarly invalidated or caught up in endless review before the USPTO.

Particularly worse is the combination of post-grant reviews (plural ? as in multiple administrative procedures) of Sections 18 and 6 of the patent reform bill, which increase the complexity of post-issue procedures before the USPTO to a mega-bureaucratic and almost byzantine level. Professor John Duffy makes this point better than I ever could. It?s probably even worse than Professor Duffy admits, because the post-grant review procedures are not clearly delineated in their application ? they simply permit post-grant review for ?non-technological inventions,? as decided by the USPTO Director. So what is a ?technological financial? product or service? Checks with anti-counterfeit technology in them? Stock trading methods that rely on computerized trading technology? Methods of hedging risks in an e-commerce commodity market? Only the current USPTO director knows! As a patent attorney, I can?t help but admire Sections 6 and 18 for the increased work and revenue they will generate in the near term for my profession. But keep in mind, this is a bill that is supposed to ?cut the red tape? and ease USPTO examination burdens. I can?t see how the creation of several new overlapping procedures for the USPTO to deal with an ambiguous class of patents it has already issued will help streamline USPTO operations. Maybe in the long-term, Sections 6 and 18 will reduce USPTO burdens, as innovators come to realize the price of dealing with these many post-grant proceedings and stop filing patents and disclosing their innovations?

Lastly, Section 5 of the America Invents Act creates a blanket defense to patent infringement for prior, secret users of a patented invention. Basically, so long as a party secretly uses an invention ?commercially? (even one use will apparently do), they are protected from ever infringing a third party?s later patent on that invention. That is, the party that uses and keeps as many trade secrets as possible can be assured individual benefit from the trade secrets without any risk of infringement if a third party manages to later replicate and patent (and thus disclose) their trade secret. This is horribly detrimental to an underlying policy goal of the patent system ? disclosure of scientific breakthroughs and technological advances. Under Section 5, an innovator has no motivation to come forward with any inventive process, because they have a patent infringement defense if a third party later patents such a process. Under current law, anyone maintaining a trade secret indefinitely runs the risk of infringing a third party?s later patent on that secret. Section 5 eliminates this risk; a manufacturer that believes they can maintain trade secrets indefinitely, such as in the case of a highly-specialized field, in extremely advanced breakthroughs, or when no competitors are seeking patent protection, faces no risk under the current patent reform bill. The result will inevitably be greater universal trade secret activity, with fewer advanced manufacturing and fabrication processes being disclosed for patent protection, entire industries potentially falling into guild-like secretive societies, and entry costs into highly advanced technology sectors greatly increasing.

Worse, (and I apologize that this paragraph is getting very ?inside baseball?) Sections 2 and 5 of the reform bill, together, potentially reverse Metalizing Engineering. The Metalizing doctrine prevents a party who commercially benefits from their trade secret from later patenting that trade secret, while allowing third parties to independently invent and patent (and thus disclose) the trade secret. Section 2, with its generic use of the term ?disclosure,? may permit the trade secret user to later patent that trade secret (despite Senator Leahy?s thinking to the contrary), while defeating any third-party ability to ensnare the trade-secret keeper in infringement. The net result of patent reform will inevitably be greater trade secret use and less public disclosure of technological advances; it is just a question of to what lengths and risks industries will go to effectively keep trade secrets. I can?t begin to guess how this is going to spur innovation and boost our economy.

To be sure, the America Invents Act includes many neutral or good things for the patent system. The legislation removes the idiosyncratic ?best mode? requirement from the patent statute, removes restrictions on Federal Circuit judge?s residency, eases signature problems with non-cooperative inventors, supercedes the Supreme Court case of Holmes Group v. Vornado, permits USPTO fee-setting, addresses false-marking lawsuit abuse (and potential unconstitutionality), liberalizes third-party submission of information relevant to the examination process, and harmonizes US patent law with the rest of the world by switching the US from a ?first-to-invent? to a ?first-to-file? jurisdiction (albeit partially and ambiguously).

Sometimes one must take the bitter with the sweet in getting legislation passed. But the above acrid ingredients ? stripping of USPTO funding, special anti-patent treatment for the financial sector, and prior user rights that undermine technological disclosure ? overwhelm the patent reform cake with bitterness, leaving maybe a single sweet cherry on top. I urge all interested practitioners to oppose the America Invents Act currently awaiting a cloture vote in the Senate by contacting your Senator, signing the petition at reformaia.org, and contacting your advocacy groups like IPO and AIPLA.
